Holders of a “Talent – Qualified Employee” or “EU Blue Card – Talent” residence permit may face job loss during the validity of their permit.
This situation raises an essential question: can the residence permit still be renewed?
*Talent – Qualified employee and Talent – Employee of an innovative company (this rule does not apply to Talent – Employee on assignment status)
Renewal allowed in case of involuntary job loss
French immigration law allows renewal of these permits even in the event of job loss, provided that the loss of employment is involuntary (Articles L.421-9 and L.421-11 of the CESEDA).
In practice:
- dismissals are covered,
- voluntary resignations are excluded.
A structured and fully digital procedure
As with any renewal application, the file must be submitted between 2 and 4 months before the permit expires.
Even if unemployed, the applicant must submit the request exclusively through the ANEF platform.
The authorities require, in particular:
- details of the previous employment,
- termination documents,
- proof of unemployment benefits issued by France Travail.
Limited validity period
When renewal is granted, the validity of the renewed residence permit is generally aligned with the duration of unemployment benefits, rather than the original permit duration.
Key takeaways
- Renewal remains possible in case of involuntary job loss.
- The application must be anticipated and filed via ANEF.
- The renewed permit is granted for a limited duration.
